Privacy policy

This policy explains what personal data we process when you visit vidiaapp.com or buy from Vidia, for what purposes, on what legal basis, who we share it with, how long we keep it and how to exercise your rights. You can find a summary of what we do with photos in Your photo privacy.

1. Controller

The controller is the owner of Vidia, whose name, NIF (Spanish tax number), address, email and telephone number are shown at the end of this policy. For any privacy matter, write to us at help@vidiaapp.com. We do not have a data protection officer because we are not required to appoint one.

2. What data we process

• Contact and purchase data. Name, email, billing address, telephone number if you give it, the products you buy, amounts, discounts and payment status. We do not see or store your card numbers.
• Photos. The photos you upload to create your videos, which may show your image or that of other people.
• Instructions. The optional text you write for your video.
• Videos. The videos we create for you, their preview with the Vidia logo and their cover image.
• Delivery record. When you open and when you download each video, because the right of withdrawal and the free redo depend on it.
• Check results. Whether a photo or an instruction was accepted or rejected, the category of the reason and the system's scores.
• Technical data. IP address, browser, device, an anonymous browser identifier we use to limit abuse, and technical security logs.
• Communications. The messages you send us and our replies.
• Cookies. Those explained in the Cookie policy.

We do not process biometric data to identify anyone. The check estimates whether a minor may appear in a photo, but it does not recognise who the person is.

3. What we use it for and on what legal basis

• Creating and delivering your videos and managing your orders, including refunds, the free redo, My videos and the record of when you open and download each video. Legal basis, performance of the contract and, to be able to prove delivery, our legitimate interest.
• Checking photos and instructions to prevent illegal or harmful content, in particular images of minors, intimate content and impersonation. Legal basis, our legitimate interest in offering a safe service and protecting the people who appear in the photos, and compliance with legal obligations such as those under the Digital Services Act (DSA).
• Invoicing and meeting tax, accounting and consumer law obligations. Legal basis, compliance with legal obligations.
• Helping you with enquiries, guarantees, withdrawals, complaints and reports. Legal basis, the contract and compliance with legal obligations.
• Security and prevention of fraud and abuse, such as mass use of the service. Legal basis, our legitimate interest.
• Aggregated statistics on how the service works that do not identify you. Legal basis, our legitimate interest.
• Sending you news if you subscribe. Legal basis, your consent, which you can withdraw at any time from any email.
• Non essential cookies and advertising pixels. Legal basis, your consent, which you manage in the cookie banner. The details are in the Cookie policy.

We need your contact details, the photo and the payment details to provide the service. If you do not give them to us, we cannot create your video.

4. Automated decisions

The checking of photos and instructions is automated and may prevent a video from being created, in which case we refund its amount. It is necessary to provide the service safely. You have the right to have a person review the decision, to express your point of view and to contest it by writing to us at help@vidiaapp.com. We do not create profiles for personalised advertising without your consent.

5. Photos of other people

If you upload a photo of another person, you confirm to us that they are an adult and have given you their permission. We use their image only to create your video and check that it follows the rules. As we do not know who they are, it is up to you to inform them. That person can ask us at any time to delete their image by writing to help@vidiaapp.com and we will do so.

6. Minors

Vidia is only for people aged 18 or over. We do not accept photos showing minors and, if we detect one, we do not create the video and we delete the photo within the periods in section 9.

7. Who we share your data with

• Shopify. Shopify International Limited, in Ireland, hosts the shop, processes payments and sends order emails, as a processor.
• Google Cloud. Google hosts our servers, databases and the storage of photos and videos in its Belgium region, as a processor.
• Google, AI services. We use the Gemini and Veo API to create the videos and review the photos. We only use paid services, in which Google acts as a processor and does not use the data to train its models. Google deletes the generated videos from its servers after 2 days.
• Payment providers. Shopify Payments and its processors, PayPal and Klarna receive the data needed to take payment and prevent fraud, in some cases as independent controllers with their own policies.
• Invoicing. The provider of the invoicing software, as a processor.
• Authorities. Public administrations, judges and courts when the law requires us to.

We do not sell your data or use your photos or videos for advertising.

8. Transfers outside the European Economic Area

Some of these providers may process data outside the European Economic Area, in particular in the United States and Canada. They only do so with appropriate safeguards, which are the European Commission's adequacy decision for Canada, the EU and US Data Privacy Framework for participating companies and, in other cases, standard contractual clauses approved by the Commission. 9. How long we keep it

• Uploaded photos you do not go on to buy, 14 days.
• Order photos, 15 days, to create the video and handle the free redo.
• Videos, with their preview and cover image, 48 hours from delivery. If you ask for the free redo, those of the previous video are deleted as soon as the new one is ready.
• Instructions, deleted together with the video.
• Technical copies, up to 7 more days in the storage backups. After any deletion, they disappear on their own.
• Order and check records, without photos or videos, 2 years, to handle complaints and prove compliance with the law.
• Invoices and accounting data, 6 years. Records of sales to customers in other European Union countries, 10 years, as required by VAT rules.
• Messages and complaints, 2 years after they are closed.
• Technical logs and copies of order notifications, 30 days.
• Newsletter subscription, until you unsubscribe.

10. Your rights

You can request access to your data, its rectification, its erasure, restriction of processing and portability, object to processing based on our legitimate interest, withdraw your consent and not be subject to decisions based solely on automated processing under the terms of section 4. Write to us at help@vidiaapp.com stating which right you are exercising. If we cannot tell that it is you, we will ask you to prove your identity. We reply within one month, which may be extended by two further months in complex cases. If you are not satisfied, you can lodge a complaint with the Agencia Española de Protección de Datos (Spanish Data Protection Agency) at www.aepd.es.

If you bought as a guest, you can also sign in to My videos with your email to watch and download your videos while they are available, or ask us to delete them early.

11. Security

We protect your data with encrypted connections, encrypted storage, temporary signed access links, restricted access to systems and two step verification. If we suffered a security breach that put your rights at risk, we would notify you and report it to the authority within the legal deadlines.

12. Changes to this policy

If we change it in a significant way, we will let you know on the website and, where appropriate, by email. The version and date are at the top of this page.
